What is the question presented to the court?  What are the parties fighting about, and what are they asking the court to decide? whether the defendant owed plaintiff a duty of care, and what that duty of care is, are key issues in negligence claims.

Determine what the relevant rules of law are that the court uses to make its decision. Elements of negligence, and the definition of “assumption of risk” as a defense. What rule must the court apply to the facts to determine the outcome?

The Supreme Court of the United States is the highest court in the country, serving as both the final court of appeal and the ultimate interpreter of the United States Constitution. Within the context of legal proceedings, the Supreme Court delineates the lines of jurisdiction between the states and the nation, as well as between states and each other, and between citizens and their respective governments.
